being on the defensive side of not risking getting my app banned, is displaying admob interstitial on top of admob banner on the same activity against the policy?

No, All in app interstitial can show with banner.
It is ok because interstitial is another activity - and will completely take over the screen (so no banner is visible also).
If the “interstitial” is a dialog type of thing with underlying app visible (as some of the interstitials from other ad networks can be) - then since the background is not clickable, I am assuming it should not be an issue. It’s not like the interstitial is misleading or leading to excessive clicks etc.
Placement of banner ads is usually advised by Google - to be far from buttons (not always possible) - but you should try to make an effort to keep them away as much as possible from buttons. Excessive clicks from placements that are nearly overlapping will wind up showing in the CTR stats - which will be very high and may lead to admob banning the admob account etc.
The situation is such that even when CTR is abnormally high for some other reason (or some bug on Admob side) - even then developers have been known to worry about “what is happening” because they fear that raises the risk of ban from admob (since many such things can be automated at admob end - it is easier to get banned than unbanned).
